LEGAL, REGULATORY & COMPLIANCE CONSULTANTS

For content producers, publishers & hosts

For content producers, publishers & hosts

Our consultants are recognised as market leaders in providing advice on the application of data protection legislation to media organisations, content producers, including independent production companies and their suppliers, and other content hosts. We also have significant experience in advising on other media and content regulation issues, such as the application of the Ofcom Broadcasting Code and the BBC’s Editorial Guidelines, and have been involved in responding to the Government’s ‘Online Harms’ agenda including the draft Online Safety Bill, and can advise organisations on the application of the proposals and steps they will need to take to prepare.

Our consultants were involved in negotiating the drafting of the exemption at Schedule 2 Part 5 para.26 Data Protection Act 2018 for processing of personal data in the context of journalism, art, literature or academia. While the exemption is broad, it does not provide a wholesale exemption from the requirements of the legislation. Our consultants have unrivalled experience in giving practical advice on its application.

As content creation has evolved and more user generated content (UGC) is created and commercialised than ever before, we work with creators and their platforms to achieve compliance.

With our consultants’ expertise spanning UGC, print media, broadcasting and publishing, we are well placed not only to support your compliance but to identify the opportunities offered by the varying applicable regulatory regimes.

Our services include:

·     Providing outsourced Data Protection Officer services to organisations engaged in processing for the special purposes

·     Advising on the circumstances in which compliance with the relevant provisions of the data protection legislation would be incompatible with the ‘special purposes’ of journalism, art, literature or academia

·     Advising on the lawful basis for processing for the special purposes

·     Carrying out data protection impact assessments in connection with processing for the special purposes

·     Advising on transparency and notification requirements to data subjects in connection with processing for the special purposes

·     Preparing, advising on and revising access agreements, which involve the sharing or other processing of personal data

·     Preparing data processing agreements in connection with processing for the special purposes

·     Advising on the extent of the obligation to comply with data subject rights requests where data is processed for the special purposes
